Terms of Use

Article 1 — Purpose

These Terms of Use (hereinafter the “Terms”) set out the terms and conditions under which users (hereinafter the “User” or the “Users”) access and use the QualiFSTD application (hereinafter the “Application”), published by Jean-Claude CHENARD, Sole Trader (Entrepreneur Individuel), SIRET 791 546 419.

Use of the Application implies full and unreserved acceptance of these Terms. If the User does not accept the Terms, they must refrain from using the Application.

Article 2 — Description of the service

QualiFSTD is a SaaS (Software as a Service) application intended for approved training organisations (ATO — Approved Training Organisation) operating flight simulation training devices (FSTD — Flight Simulation Training Device), enabling in particular:

  • monitoring the regulatory compliance of FSTDs against applicable EASA requirements;
  • planning and tracking periodic qualification tests (QTG — Qualification Test Guide);
  • managing documentation relating to the certification and continued qualification of FSTDs;
  • tracking the maintenance programme recommended by the manufacturer;
  • generating briefing documents for audits by the competent authority;
  • reporting and tracking faults or anomalies observed on FSTDs.

The publisher reserves the right to develop, modify or supplement the features of the Application at any time, in order to improve its quality and the service provided, without this giving rise to any right to compensation for the User.

Article 3 — Access to the service and account creation

Access to the Application requires the creation of a user account, linked to an organisation (ATO). Access is reserved for natural persons acting within the scope of their professional activity within an approved training organisation or a structure operating an FSTD.

The User undertakes to:

  • provide accurate, up-to-date and complete information upon registration;
  • maintain the confidentiality of their login credentials;
  • inform the publisher without delay of any unauthorised use of their account of which they become aware.

Each account is personal. The User is responsible for all actions carried out from their account.

User roles

The Application distinguishes several roles within a single organisation (in particular: ATO manager, FSTD compliance officer, instructor), each with access rights suited to their functions. The organisation’s ATO manager is responsible for assigning and managing the access rights of their staff.

Article 4 — User obligations

The User undertakes to use the Application in accordance with its intended purpose and applicable regulations. In particular, they undertake to:

  • not use the Application for fraudulent purposes or purposes contrary to public order;
  • not attempt to undermine the security or integrity of the Application or the data it contains;
  • not extract, reproduce or reuse all or part of the structured regulatory content present in the Application for competing commercial purposes;
  • enter accurate information regarding the compliance status of their FSTDs, the Application being only a management tool and not an inspection body.

The User remains solely responsible for the accuracy of the data entered and for the actual compliance of their FSTD(s) with the applicable regulations and the requirements of their competent authority. QualiFSTD is a management aid and in no way relieves the User of their own regulatory verification obligation.

Article 5 — Availability of the service

The publisher endeavours to ensure continuous availability of the Application, without however being able to guarantee uninterrupted access. Interruptions may occur for maintenance operations, updates, or for reasons beyond the publisher’s control (network failure, force majeure, failure of a third-party provider such as the host).

The publisher endeavours to inform Users of scheduled interruptions as far as possible.

Article 6 — Intellectual property

All elements of the Application (structure, code, database, graphical interfaces, QualiFSTD trademark) are protected by intellectual property law and remain the exclusive property of the publisher. No provision of these Terms may be construed as an assignment of intellectual property rights to the User.

The data entered by the User (information relating to their FSTDs, test results, uploaded documents) remains the property of the User or their organisation. The publisher claims no ownership of this data and uses it only for the purpose of providing the service.

Article 7 — Protection of personal data

The processing of personal data in connection with the use of the Application is described in the Privacy Policy, which complies with the General Data Protection Regulation (GDPR — EU Regulation 2016/679). The data is hosted and processed within the European Union (Supabase infrastructure).

Article 8 — Limitation of liability

The publisher makes every effort to ensure the accuracy of the regulatory information integrated into the Application (EASA references, QTG tests). However, the publisher cannot be held liable for:

  • any inaccuracy, omission or unreflected change in the applicable regulations;
  • decisions made by the User solely on the basis of the information in the Application;
  • any direct or indirect damage resulting from a service interruption, a loss of data, or non-compliant use of the Application by the User.

The Application is a compliance management aid and in no way constitutes regulatory advice, certification, or a substitute for the expertise and own responsibility of the FSTD manager, the ATO, or their relations with the competent authority.

Article 9 — Suspension and termination

The publisher reserves the right to suspend or terminate a User’s access to the Application, without notice, in the event of a serious breach of these Terms, in particular in the event of fraudulent use, breach of the security of the service, or non-payment of amounts due under the subscription (see Terms and Conditions of Sale).

The User may at any time request the deletion of their account and data, under the conditions described in the Privacy Policy and the Terms and Conditions of Sale.

Article 10 — Modification of the Terms

The publisher reserves the right to modify these Terms at any time, in particular to take account of legal, regulatory or functional developments of the Application. Users will be informed of any substantial modification by any appropriate means (notification in the Application, email). Continued use of the Application after notification constitutes acceptance of the modified Terms.

Article 11 — Applicable law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall, failing amicable resolution, fall within the jurisdiction of the French courts.
